An Overview of Expungement and Sealing in Chicago

The law is very clear about who qualifies for expungement and sealing in the state of Illinois. It says that only individuals who have never been convicted of a criminal offense or municipal ordinance violation are eligible for expungement. However, the law does make some exceptions for honorably discharged veterans of the U.S. Armed Forces who have committed certain Class 3 or Class 4 felonies.

You cannot expunge federal and out-of-state convictions under Illinois law.

Felony Convictions That Don’t Count for Expungement

Some “special” felony probations, such as TASC, first-offender drug probation under Section 10 of the Cannabis Control Act, Section 410 of the Controlled Substance Act, or Section 70 of the Methamphetamine Control and Community Control Act are not considered convictions—and that means they may be eligible for expungement or sealing.

Juvenile Expungement

Juvenile expungement in Chicago and the surrounding communities, including Rolling Meadows and Skokie, is different from adult expungement.
